These Terms of Service ("Terms") govern your access to and use of the Hola Revenue website and missed-call revenue-recovery service (together, the "Service"), operated by Hola Revenue ("Hola Revenue," "we," "us," or "our"), based in Vancouver, British Columbia, Canada. By booking a call, signing up for, or otherwise using the Service, you agree to these Terms. If you're agreeing on behalf of a business, you're confirming you have the authority to do so, and "you" refers to that business.
Hola Revenue helps local service businesses recover missed-call revenue: when a call to your business goes unanswered, our system automatically sends a text message to the caller, carries on a short qualifying conversation, and delivers the resulting lead to you. Setup, pricing, and any pilot or trial terms are confirmed directly with you before the Service goes live on your number.
Any revenue, savings, or "recovered" dollar figures shown on our website, in our calculator, in our one-pagers, or in sales materials are illustrative estimates only, based on assumptions we state alongside them (such as an assumed share of missed callers who would have booked, and an assumed recovery rate). They are not a guarantee of results for your specific business. Actual outcomes depend on your call volume, average job value, industry, and how leads are followed up on.
You must be at least 18 years old and able to enter into a binding contract to use the Service. You're responsible for the accuracy of the information you give us, and for keeping any account credentials confidential.
You confirm that:
You are responsible for how you and your staff use the leads generated by the Service, including complying with your own legal and professional obligations toward your customers.
The Service works by sending automated text messages to people who call your business and don't reach you. By using the Service, you agree that:
See our Privacy Policy for more on how message data is collected, used, and shared.
You agree not to: reverse-engineer or resell the Service without our written permission; use the Service to send spam, phishing, or fraudulent messages; interfere with or disrupt the integrity or performance of the Service; or attempt to gain unauthorized access to our systems or other customers' data.
The Service relies on third-party providers, including Twilio (messaging and voice infrastructure), Stripe (payments), and Calendly (scheduling). We choose these providers carefully, but we don't control them, and we're not responsible for outages, errors, or changes on their end. Your use of those providers' own services may also be subject to their terms.
Hola Revenue and its logo, website content, and underlying technology are owned by Hola Revenue or its licensors and protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks, branding, or proprietary technology beyond what's needed to use the Service as intended.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular number of leads, bookings, or amount of revenue will be recovered.
To the fullest extent permitted by law, Hola Revenue will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the claim arose.
You agree to indemnify and hold Hola Revenue harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right - including claims related to consent for text messages sent to your customers.
Either party may terminate the Service as set out in your service agreement, or with reasonable notice if none is specified. We may suspend or terminate the Service immediately if you materially breach these Terms, including by directing us to message recipients without proper consent.
We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll take reasonable steps to notify active Customers directly. Continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
